The Office of the Information Commissioner Qld (OIC) is committed to providing access to information. A part of that commitment means ensuring we accommodate feedback and complaints both by the IP Act’s and RTI Act’s requirements, and by the standards of our own Complaints management policy.

Your options if your complaint is regarding:

If you want to make a formal privacy complaint to a government department or agency, you can find information on the process foron our Government breach of privacy page.

If you want to challenge a decision made by the Office of the Information Commissioner, you may try informally resolving the issue with the person in the OIC you are dealing with. If you are unhappy with the response from that person, ask to speak with their supervisor.

However, if the OIC cannot deal with this situation further and you feel dissatisfied with the decision you received, you are not able to resolve this disagreement through a formal complaint to the OIC.

Instead, you need to consider making an application to the Supreme Court under the Judicial Review Act 1991 (Qld) for a judicial review. You can only seek a review on a point of law.

There are also options for privacy complainants or those who using the External Review service to make an application for appeal to the Queensland Civil and Administrative Tribunal (QCAT). Again, these appeals can only be made on a point of law, and statutory time limits may apply.

In providing its services, the OIC must comply with the privacy principles in the Information Privacy Act 2009. If the OIC has breached your privacy, you can make a privacy complaint about the actions of the OIC.

You must first make their complaint directly to the OIC and give us the opportunity to respond to the issues raised in the complaint.

Step 1 – Try to resolve issues informally

The quickest way for your complaint to be resolved is to raise your issue with the person in the office you are dealing with. If you are unhappy with the response from that person, ask to speak with their supervisor.

Step 2 – Make a formal complaint

If you remain dissatisfied after speaking with the person you are dealing with and their supervisor, you may wish to make a formal complaint. Formal complaints must:

  • be in writing
  • include all the issues you are concerned about with supporting detail

We will aim to resolve the matter and provide a written response and outcome within 28 days. If your complaint involves the Human Rights Act 2019, we have 45 days to respond.

Under the Crime and Corruption Act 2001 (CC Act), the Crime and Corruption Commission (CCC) has responsibility for ensuring complaints about corruption are dealt with appropriately, with a particular focus on cases involving more serious or systemic corrupt conduct. The CCC has jurisdiction over corrupt conduct affecting public sector bodies in Queensland, including departments, statutory bodies, universities, and local government.
